What does "Blood Alcohol Content" (B.A.C.) mean? What are the legal presumptions associated with a certain B.A.C.?

The "Blood Alcohol Content" (B.A.C.) of a DUI suspect is a measurement used to identify how much alcohol is in the DUI supect's blood. Ethyl Alcohol is routinely measured to determine if a DUI suspect is impaired. The amount of ethyl alcohol in the DUI defendant's blood system is evidence in a DUI case. The BAC is measured as a percentage of alcohol in the blood. At different levels of the percentage of alcohol in the blood, an individual exhibits different effects from the alcohol including impairment. Depending on the amount of alcohol an individual consumes, their body weight, how much food they ate on the day of alcohol consumption are all factors in determining the effects of the alcohol on the DUI suspect including impairment.

The legal limit for driving in California is .08 BAC. This means that a driver may not drive when their blood alcohol content is .08 alcohol ( one eighth of one percent). The law presumes impairment of the driver when the BAC is .08. At .10 BAC an individual's blood alcohol content is one tenth of one percent. At .20 BAC an individual's BAC is 2 tenths of one percent, and so forth.

Intitially when an individual comsumes alcohol it takes some time for the alcohol to enter the blood. People may develop a tolerance for alcohol. An individual with a tolerance for alcohol may not be impaired with a BAC at .08. Will this person still be convicted of DUI?

Blood Alcohol Caluculators may give you an idea of the amount of alcohol you may cosume without being considered legally intoxicated. However, do not rely on these calculators to determine if you can drive while you have been drinking.
