What are the Mandatory Minimum Sentences for a 1st Offense DUI Conviction in Orange County, California?

 

The mimimum sentence requirements described herein are what I have consistently seen in southern california courts. Be advised that each court operates a little different and this mandatory minimum sentence description is general in nature and not a prediction of the sentence you could receive for a DUI conviction. In fact, the sentence can be worse. Moreover, there are other incidental fines, fees, restrictions and conditions you must satisfy to complete the terms and conditions of your DUI sentence. 1st Offense D.U.I. Mimimum Sentence Requirements for Violating California Vehicle Code 23152 (a) & (b).

 

(1) Probation: Usually 3 years probation is given as part of a 1st offense DUI. It could be longer depending on the circumstances of your particular situation. As a condition of probation you are not to violate any laws. Such a violation could violate the terms of your probation and as a result the consequences could be very severe. Be responsbile and satisfy the conditions of your probation.

 

(2) Pay a fine of approximately $390.00 plus the state's penalty assessment fee. Generally speaking, the penatly assessment triples the amount of the fine.

 

(3) Complete a 1st Offender Alcohol Program (Under AB541).

 

(4) Addtiitonal fines, fees, restrictions, and conditions are usually imposed.
